Description The contribution is focused on certain legal issues related to ensuring adequate protection of public health with regard to the adequate house lighting . In this context, it could be argued somewhat problematic "legal certainty" resulting from the already approved planning documentation. Change of a planning documentation as a strategic concept as set as de lege lata may not always be comprehensively assessed (and subsequently enforced). Requirements to ensure adequate lighting for human health are therefore not in comprehensive focus. This problem will occure especially between a conflict of interest for environmental protection in one hand and the interests of public health in the process of assessing the impact of concepts on the environment 'Strategic Environmental Assessment' (SEA) on the other hand. Current legislation does not sufficiently cover effective tools for solving the case, if there is administratively no consensus whether to be implemented (or not) the procedure of public health assessment, "Health Impact Assessment '(HIA). They may therefore be reasonabledoubt in terms of successful enforcement of human rights to protect public health.
